James F. Gallagher, P.E., F.ASCE, a principal with Resolution Management Consultants Inc., and licensed as a professional engineer in 13 states, has been elevated to the status of Fellow by the ASCE Board of Direction.
Gallagher has over 30 years of hands-on experience in contract development, construction/project management, and construction claims prevention and resolution. He started his engineering career as a field engineer for Peter Kiewit and Sons, Eastern Division on the Moose River Hydroelectric Power Plant in Lyons Falls, NY. He received an ASCE Certificate of Appreciation for “Expert Report Preparation and Testimony Presentation” (2016) and was featured in an ENR feature article, “The Upcoming Demand for Engineers” (Oct. 19, 1992).
His experience spans all types of construction services on institutional, commercial, power, environmental, marine, educational, and transportation projects, including highway/bridges, light rail, and airports on behalf of owners/operators and government agencies to contractors, engineers, architects, attorneys, and vendors. Gallagher has led and performed management and risk audits, development of project controls, and risk assessments of public and private projects.
His construction experience encompasses contract preparation, field monitoring and inspection, construction scheduling development and updating, change-order analysis, contract-compliance audits, project closeout negotiations and claims analysis involving schedule delay, disruption and acceleration, and cost impact and extra work, as well as differing site conditions cost estimating, budget assessments, termination, and damage calculations.
Drawing upon the knowledge and experience gained over the years on prior assignments and having seen the issues from both sides of the table, he has been successful in scanning through the documentation and events to address the most relevant issues and provide RMC’s clients with the strengths and weaknesses of all parties’ respective positions. Gallagher has provided dispute avoidance and resolution services on projects of varying size and type, working with both the private and public sectors, involving projects worldwide and ranging in value from $500,000 to $1.5 billion on which various contracting vehicles were employed, including fixed-price, unit price, cost reimbursement, and guaranteed maximum price, and issued under traditional design-bid-build, design-build, engineering, procurement construction, and public-private partnership procurement methods. He’s also provided contract-compliance audit services on projects ranging in value from $50 million to $1.5 billion, and included assistance to public and private clients in the recovery of costs that were not necessarily incurred in the performance of the work or reimbursable under the contract.
Gallagher has provided expert witness testimony on a number of cases, including at arbitration and trial, and is experienced in settlement discussions, mediation, and dispute review boards. He has also been delivering presentations and training seminars for the past 20 years to professional organizations, companies, and groups on topics such as project delivery systems, project management, change order management, differing site conditions, loss of productivity, minimizing and managing risks and disputes, and construction schedule methodologies.
Gallagher earned his bachelor of science in civil engineering in 1986 from Drexel University in Philadelphia.
